Tory Summey provided analysis to the Society for Human Resource Management on how employers can handle employees not wearing masks or social distancing away from work. 

Tory said the options available to employers largely depend on whether the state in question has laws protecting employees from discipline for lawful off-duty conduct. He also pointed out that employees who are concerned about their co-workers' off-duty conduct - and feel like their employer isn't adequately responding to their concerns - could pursue complaints with federal or state workplace safety authorities. In those cases though, employers would have ample avenues to defend themselves.
