Beth Morris has represented school districts in Georgia since 2005. She focuses her practice on issues involving children with disabilities, regularly advising clients on the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act. She represents school districts in due process hearing requests as well as Department of Education and Office for Civil Rights complaints. She often conducts statewide trainings on these issues.

Beth’s practice also includes board governance, state and federal litigation, Title IX, personnel and transactional matters, and administrative complaints involving the Equal Employment Opportunity Commission.

Beth works closely with the Georgia Council of Administrators of Special Education and serves as a member of the Executive Board of the Child Protection and Advocacy Committee of the State Bar of Georgia.

Before joining Parker Poe, Beth served as a partner for a Georgia firm focusing on education-related legal matters.

Representative Experience

  • Represented school districts in disputes, administrative proceedings, and litigation in Georgia administrative, state, and federal courts in a range of matters that include:
    • Claims of discrimination, harassment, and retaliation based on age, gender, race, disability, religion, and national origin.
    • Employment matters, including preparation of employment contracts, employee handbooks and policies, and employment issues relating to reduction in force.
    • Claims arising under the Fair Dismissal Act.
    • Claims of violations of the Individuals with Disabilities Education Act.
    • Claims of violations of Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act.
    • FMLA implementation and compliance.
    • Title IX compliance, policy development, and complaints.
    • Student disciplinary matters, student discipline tribunals, and appeals.
    • Other legal issues that are unique to public and private colleges, universities, and K-12 schools.
  • Negotiated hundreds of resolutions between school districts in Georgia and parents regarding services and accommodations under IDEA, Section 504, student disciplinary and personnel matters.
  • Secured a favorable ruling from an OSAH administrative law judge following a five-day trial regarding provision of FAPE and other legal issue with significant implications for a school district’s obligations under IDEA.
  • Secured a favorable ruling from an OSAH administrative law judge following a five-day trial on an issue with significant implications for all school districts in Georgia regarding eligibility under IDEA.
  • Secured a favorable ruling in federal court appeal from OSAH administrative ruling appealed to Northern District of Georgia in IDEA matter.
  • Conducted hundreds of trainings on school districts’ legal obligations and applicable laws on all issues, including, but not limited to, IDEA, Section 504, Title IX, discipline, custody issues, FERPA, FMLA, discrimination, bullying, and legal trends.
