Opinion Work & Counseling

General Patent Counseling. Providing outside general IP counsel on U.S. and global patent protection, enforcement, and infringement risks strategies.
Patentability Analysis. Assessing the novelty and non-obviousness of inventions to determine the likelihood of achieving worthwhile patent scope.
Freedom-to-Operate Opinions. Evaluating whether clients’ products or processes might implicate others’ existing patents, thereby minimizing infringement risks.
Validity Opinions. Analyzing the strength and enforceability of existing patents, providing insights into potential challenges or defenses.

Patent Application, Preparation & Pursuit

Patent Drafting. Preparing detailed patent applications that seek to (a) broadly protect clients’ inventions, (b) guard against design-around by competitors, and (c) “future-proof” clients’ patents.
Patent Filing. Submitting patent applications to the relevant patent offices and managing all procedural requirements.
Prosecution. Engaging with patent examiners to address any objections or rejections, advocating for the approval of the patent applications.
International Patent Protection. Coordinating the filing and prosecution of patents in jurisdictions worldwide to secure global protection for our clients’ inventions.

Patent Litigation

Infringement Litigation. Representing clients in legal disputes in which patents are being infringed upon, seeking remedies such as injunctions and damages.
Defense Against Infringement Claims. Defending clients against allegations of patent infringement, pursuing defenses of (a) noninfringement, (b) invalidity, and (c) limits to damages, while also providing settlement off-ramps for consideration.
Patent Enforcement. Taking legal action to enforce patent rights, ensuring competitors respect our clients’ intellectual property.

Representative Experience

Served as U.S. patent counsel for multinational manufacturing companies, providing the full suite of patent services.
- Served as U.S. IP counsel to a U.S.-owned, Charlotte-based manufacturer of industrial heating systems with additional manufacturing facilities in Europe. We provide full patent services as well as other IP services for this client.
- Served as U.S. IP counsel to a Danish-owned manufacturer specializing in roof windows, skylights, sun tunnels and related building products for commercial and residential use.
- Served as IP counsel to a Sweden-based coatings and floor care products company with U.S.-based manufacturing and research facilities.
- Served as IP counsel to a Finland-based innovation and technology company specializing in transfer of functional chemicals and delivery of active ingredients.
Litigated over 100 patent cases across the U.S., including in top venues known for high-stakes intellectual property litigation.
- Represented a U.S. subsidiary of a Taiwanese-owned global manufacturer of power equipment with applications in the automotive, energy, and industrial equipment industries in multiple patent litigation cases. We have recently been successful in settling a major piece of litigation at a significant savings to the company.
- Served as lead counsel for global generic pharmaceutical companies in patent litigation before U.S. district courts and U.S. Patent and Trademark Office (USPTO) proceedings, with numerous cases resulting in favorable outcomes.
