Eminent Domain & Condemnation

Overview

Parker Poe attorneys have decades of experience helping clients navigate the complexities of eminent domain laws and condemnation procedures. Our team includes the author of the original textbook on eminent domain laws in Georgia, as well as the current editor of the Georgia chapter in the authoritative compendium on eminent domain laws across the United States. Our attorneys in Georgia and the Carolinas are nationally recognized, including through speaking at conferences around the country and rankings in The Best Lawyers in America and Benchmark Litigation.

We represent a broad spectrum of businesses and commercial property owners as well as governmental entities and utilities with property interests and projects throughout the U.S. Our experience representing both property owners and condemning authorities results in a well-rounded perspective and comprehensive approach to formulating strategies and trying cases – we understand every aspect of eminent domain and have built relationships across this area of law.

We also invest the time to understand the individual needs of each client. We consider ourselves their partners and problem-solvers, helping them work through what can be a daunting process. This customized approach, combined with our deep experience, enables us to drive negotiations for compensation and reach resolutions that make business sense.

Our clients also benefit from the strength of our entire 275-attorney firm stretching from Atlanta to Washington, DC. Our team frequently collaborates with our broader real estate, energy, environmental, and local government teams.

Areas of Focus

Managing Condemnation Needs in Georgia & the Carolinas

Our team can either assume management of or assist in-house teams in managing acquisitions impacting clients' locations in Georgia, North Carolina, and South Carolina. This includes direct communication with condemning authorities, appraisers, and engineers; initial investigations of the project; recommendations to reach resolutions; and status tracking with regular updates on progress.

Managing Condemnation Needs in Other States

We can assist clients with the management and tracking of eminent domain matters and condemnation procedures for their locations across the U.S. We advise on potential claims and coordinate and negotiate  with local project representatives and counsel to resolve matters for our clients. We also have a substantial network of contacts and relationships across the country to assist our clients if and when litigation arises.

Tracking Future Public Projects Impacting Clients' Locations

We can track and provide updates on future and pending condemnation projects as they impact specific client locations. We report on project specifics, including plans and schedules for design, right of way, and construction plans. We also help clients identify projects where they should expect the biggest impact on their property.

Consulting on Contractual Documents

We advise and assist clients with updating, revising, and preparing contractual documents to ensure all condemnation-related provisions best protect their interests. This includes leases, purchase and sales agreements, franchise and jobber agreements, and private easements.

Providing Continuing Education, Training & Seminars

Our team can prepare and present on any real estate-related topic of interest to the legal, real estate, management, and engineering departments or teams within your company. We regularly conduct seminars for clients as an added value of working with our firm.
